Public liability (or general liability) insurance covers you for legal costs and compensation that you may have to pay if you are found liable to someone because you caused them physical or mental harm, or loss or damage to their property.  It will also cover your own defence costs.

Public liability insurance also applies where you are liable for the actions of another party acting on your behalf (“vicarious liability”), such as an employee or sub-contractor. 

Please note that this is a claim notification form ONLY. Your insurer may still require a claim form to be completed or request other additional information.

In the event of any liability claim against you, we have set out the following general guidelines to assist:

  • If an injury is involved, provide the necessary emergency assistance to the injured party
  • Obtain the names, address and phone numbers of involved parties 
  • Do not admit fault or responsibility to any party in any form whatsoever as it could harm your insurance claim – “prejudice”. We know it’s only human to want to, but you may not have all of the facts and it’s possible for example, that either some intervening action by another party has caused the harm complained of, or you have an enforceable clause in a contract which either limits your liability or absolves you from it
  • Take photos and contact your Broker as soon as possible
  • Liability claims can be complex and expensive, so it is best to keep notes of conversations/meetings and gather as much information as possible for your insurer to assist with the claim
  • Even if you think you’re not liable you should notify a claim – you will still need to be defended if a third party pursues the matter against you
  • And even if you think you’re not covered you should still notify a claim – not only are liability claims complex, so are the policy wordings. Your Broker might just be able to find a home for your claim
  • If you receive a demand, writ, summons or notice of claim immediately advise your Broker. Do not respond to anything until you have spoken to your Broker and have their advice
  • But remember any information you gather may be discoverable if proceedings are issued against you, so please do not express any views or conclusions on liability even in your internal documents or in the claim notification form itself. Again, this could prejudice the claim.
